Couldn't this palette be generated at run-time by code? Or be hardcoded as data
instead of in a file? Then it would be clearly code (and licensed as such), and
also there would be no risk of any clueless individual modifying and
redistributing it without renaming it, so both parties in this discussion would
be happy.

In general, I don't see the point in having separate data files for a few
kilobytes of data that is not supposed to be changed. Sure, it takes a bit of
more effort to write the code so support hardcoded palettes in the source code,
but it could even be an Easy Hack.
